Theme 1: Data Act

  • What is “cloud switching”? And what is the intent of interoperability?
  • Operationally, how can cloud providers deliver customers’ data in a functionally equivalent form within 30 days upon request or at the end of the contract?
  • What does “appropriate” support entail when “seamlessly” switching to a competitor provider, and how should metadata be treated? How are cloud businesses ensuring customers can enjoy “functional equivalence”?
  • How are price models likely to adapt, and what impact might that have on smaller players/edge computing services? Could new opportunities for standardised data exchange interfaces emerge?
  • In practice, what issues are likely to arise concerning “exits” – planned vs. unplanned?

Theme 2: DORA

  • To prevent concentration risk, companies are adopting multi-cloud strategies. But in an increasingly interoperable world, with more technical layers and possibly open-source software leveraged, how can financial services entities practically complete end-to-end testing? Specifically for exit testing, when migration may take months (or even years), and exit support could be as short as 30 days for data migration.
  • How can cloud vendors comply with the initial ICT-related incident reporting timeline of four hours if the tech stack becomes more complicated?
  • Pooled Threat-Led Penetration Testing facilitated by an external tester is helpful for multi-tenant environments. However, what happens to the costs required for IT resources to scope and understand client infrastructure? Will there be greater dependence on the systems integrator role? Is compliance as a service likely to prevail in this space, as with GDPR – i.e., increased service level commitments for highly regulated workloads?
  • Will the solution be more standardised or focus on specific accreditations, such as Europrivacy, linked to vulnerability scans, open-source analyses, and penetration testing?

Speaker bios:

Anthony Purvis
Anthony is the head of Employment Law at Waterfront Law, a firm specialising in technology, employment, IP, commercial and corporate law.

Anthony has extensive experience in advising both employers and employees on all aspects of employment law, from drafting contracts and restrictive covenants to disciplinary issues and grievances, dismissals, TUPE,  and parental leave. Anthony has worked with employee parents, as well as employers, on return to work issues, shared parental leave, KIT days, and many other related topics.

Anthony also has young children and has taken parental leave himself, so he has first hand experience of what it involves and the sorts of issues that can arise.

Anna Ward
Anna is a commercial, IP and data protection lawyer at Biztech Lawyers. She has worked at a number of different law firms in London and elsewhere including Waterfront Law and Mishcon de Reya.

Anna has taken maternity leave twice in the last few years, applied for promotion during the short 8 month period in between maternity leaves and navigated KIT days both during and after the pandemic. When she returned to work after her first maternity leave, she negotiated a different working pattern to fit around family life and is looking forward to discussing these experiences.

Fiona Campbell
Fiona is an in-house data protection lawyer at Informa PLC. She has previously worked at both magic circle and boutique private practice firms in data protection and commercial litigation.

Fiona took shared parental leave in 2022 whilst working in private practice and will be soon be taking her second period of shared parental leave whilst working in-house. She made full use of KIT days, a staggered re-entry to work and experimented with a period of working part-time before returning to full time work. She looks forward to sharing her experiences on these varied issues.

Ben Packer
Ben is a partner in the Litigation, Arbitration and Investigations team at Linklaters LLP, specialising in disputes in the tech, financial services and sports sectors. He was one of the first men at the firm to take shared parental leave when his second daughter was born in 2016 and can share his experiences of navigating a new type of leave for the industry, the impact on his family life and on his career.

Sophie Rees
Sophie is a Senior Associate in the Corporate team at Bristows LLP, specialising in M&A and investment matters across the Technology and Life Sciences sectors. She sits on the Bristows Women’s Network Committee and regularly participates in mentoring schemes as both a mentor and mentee.

Sophie is currently on her second period of maternity leave and we are grateful to her for taking the time to join us to share her experiences of taking maternity leave, navigating leave-related considerations and returning to transactional work.

  • what computers actually are, how they’re laid out, and work;
  • how the Internet works, and how the web works (they’re not the same!);

Speaker Bios:

Neil is an Internet, tech, and telecoms lawyer. He runs English law firm decoded.legal. He’s good at legal advice, particularly geeky tech stuff, but rubbish at writing bios.

Simon Forrester has been a professional developer since the 1990s, delivering solutions for the private and public legal sectors, civil, commercial, and criminal. He’s worked with the Society for over two decades: if you’re watching an SCL online event, it’s invariably Simon pushing buttons behind the scenes! He’s also presented various events, including previous Back To Basics sessions, and both online and in person. At the time of writing he’s polishing his presentations and limbering up for six hours of Back To Basics 2024.

Tech Fundamentals is a structured day-long program for people with relatively basic tech knowledge. It starts with the very basics of computing and works through networks and connectivity, software development, security and encryption, and hosted / cloud services. Join us for an in-depth exploration of the Information Commissioner’s Office’s (ICO) approach to AI and data protection. With AI rapidly advancing, it is critical that organisations consider how data protection principles apply to the use of personal data in AI systems.

This webinar will feature insights from a senior lawyer at the ICO, offering a detailed examination of how the ICO is addressing the complex challenges posed by AI technologies. We will discuss the types of risks that should be included in a Data Protection Impact Assessment (DPIA) when organisations are considering adopting an AI solution. We will also discuss some of the lessons learned from the ICO’s investigation into Snap’s “My AI” chatbot.
